Article 11 — Small Water Supply Watershed Ordinance

§ 11.1

Definitions

§ 11.1.1

Buffer means a natural or enhanced vegetated area with no or limited

minor land disturbances, such as trails and picnic areas.

§ 11.1.2

Corridor means all land within the buffer areas and other setback areas

specified in sections 11.2.1 and 11.2.2 of this ordinance.

§ 11.1.3

Impervious Surface means a man-made structure or surface that prevents

the infiltration of stormwater into the ground below the structure or surface. Examples are buildings, road, driveways, parking lots, decks, swimming pools or patios.

§ 11.1.4

Perennial Stream means a stream that flows throughout the whole year as

indicated on a USGS Quad map.

§ 11.1.5

Reservoir Boundary means the edge of a water supply reservoir defined

by its normal pool level.

§ 11.1.6

Utility means public or private water or sewer piping systems, water or

sewer pumping stations, electric power lines, fuel pipelines, telephone lines, roads, driveways, bridges, river/lake access facilities, stormwater systems and railroads or other utilities identified by local government.

§ 11.1.7

Water Supply Reservoir means a governmentally owned impoundment

of water for the primary purpose of providing water to one or more governmentally owned public drinking water systems. This excludes the multipurpose reservoirs owned by the U.S. Army Corps of Engineers.

There is not a surface water supply reservoir in the City of Lawrenceville or within seven (7) miles of the City limits.

§ 11.1.8

Water Supply Watershed Area means the area of land upstream of a

governmentally owned public drinking water intake. The City of Lawrenceville has a water supply watershed area smaller than one hundred

(100)square miles of land within basin upstream of the City of Lawrenceville public drinking water supply wells.

§ 11.1.9

Water Supply Watershed Basins means the City of Lawrenceville has

seven watershed sub-basins. These sub-basins are part of the Yellow River and Alcovy River. These sub-basins are the Cedar Creek Basin (Alcovy River), Pew Creek Basin (Yellow River), Redland Creek Basin (Yellow River), Shoal Creek Basin (Alcovy River), Sub-basin of Alcovy River Basin, Sub-basin of Yellow River Basin and Yellow River Basin.

§ 11.2

Protection for Small Water Supply Watershed Ordinance

§ 11.2.1

Stream Corridor Criteria for Small Water Supply Watershed: The

11.2.1 Stream Corridor Criteria for Small Water Supply Watershed:

The perennial stream corridors of a small water supply watershed within a seven (7) mile radius upstream of a governmentally owned public drinking water supply intake or water supply reservoir are protected by the following criteria1:

(1)A buffer shall be maintained for a distance of 100 feet on both sides of the stream as measured from the stream banks.

(2)No impervious surface shall be constructed within a 150 foot setback area on both sides of the stream as measured from the stream banks.

(3)Septic tanks and septic tank drainfields are prohibited in the setback area of 11.2.1(2) above.

§ 11.2.2

The perennial stream corridors within a small water supply watershed and

outside a seven (7) mile radius upstream of a governmentally owned public drinking water supply intake or water supply reservoir are protected by the following criteria:

(1)A buffer shall be maintained for a distance of fifty (50) feet on both sides of the stream as measured from the stream banks.

(2)No impervious surface shall be constructed within a seventy-five

(75)foot setback area on both sides of the stream as measured from the stream banks.

(3)Septic tanks and septic tank drainfields are prohibited in the setback areas of 11.2.2(2) above.

§ 11.2.3

The following criteria apply at all locations in a small water supply

watershed:

1 The City of Lawrenceville has no surface water supply reservoir at the time of the adoption of this ordinance; this provision will only apply if the City or an adjoining governmental entity constructs a drinking water supply intake or water supply reservoir within a seven (7) mile radius downstream of the City of Lawrenceville.

(1)New sanitary landfills are not allowed within the City of Lawrenceville.

(2)New hazardous waste treatment or disposal facilities are prohibited.

(3)The City of Lawrenceville has adopted impervious surface area restrictions within its current zoning ordinance. The City of Lawrenceville Zoning Ordinance impervious surface restrictions are hereby incorporated into this provision. The goal of this provision is to ensure that the impervious surface area within the City is limited to twenty-five percent (25%).

(4)New facilities which handle hazardous materials of the types and amounts determined by the Department of Natural Resources, shall perform their operations on impermeable surfaces having spill and leak collection systems as prescribed by the Department of Natural Resources.

§ 11.3

Miscellaneous Provisions

§ 11.3.1

Severability

If any term, requirement or provision of this article or the application thereof to any person or circumstance shall, to any extent, be invalid or unenforceable, the remainder of this article or the application of such terms, requirements and provisions to persons or circumstances other than those to which it is held invalid or unenforceable, shall not be affected thereby and each term, requirement or provision of this article shall be valid and be enforced to the fullest extent permitted by law.

§ 11.3.2

Liability

Compliance with the provisions of this article shall not relieve any person from the responsibility for damage to any person or property otherwise imposed by law neither shall it impose any liability upon the city for damage to any person or property.
