Interpretation of Map Boundaries
The following rules shall apply with respect to zoning district boundaries shown on the Official Zoning Map.
(a)The boundaries of the zoning districts as shown on the Official Zoning Map shall be based on the legal descriptions associated with approved annexation, rezoning, or special use applications or, in the absence of such legal descriptions, the location of the boundary as depicted on the Official Zoning Map. In cases where questions arise as to the boundaries of a zoning district or overlay district, the rules of this section shall apply.
(b)Where boundaries are indicated as approximately following the centerline of streets, highways, or railroads, such centerline, right-of-way lines or such lines extended shall be construed to be such boundaries.
(c)Where boundaries are indicated as approximately paralleling the centerline of streets, highways, or railroads, the location of said boundaries shall be determined by using the edge of such right-of-way.
(d)Where boundaries are indicated as approximately following the corporate limit line of a city, such corporate limit line shall be construed to be such boundaries.
(e)Where boundaries are indicated as approximately following property lines or such lines extended, such property lines or such lines extended shall be construed to be such boundaries.
(f)Where boundaries are indicated as approximately following the centerline of stream beds or riverbeds, such centerline shall be construed to be such boundaries.
(g)Where a public street or other right-of-way is officially vacated or abandoned, and said street or right-of-way is also a zoning district or overlay district boundary, the regulations applicable to the property to which it reverted shall apply to such vacated or abandoned public street or right-of-way.
(h)In the case where the exact location of a zoning district or overlay district boundary cannot be determined by the foregoing methods, the Director shall have the authority to determine the location of the boundary. Any such administrative determination is subject to appeal in accordance with Chapter 18-7 of this ULDC.
