Article 9 — Use Provisions, Chapter 9-3 — SPECIFIC DISTRICT USE STANDARDS

§ 9-3-1

R-I-A, R-I and N-C District Use Standards

The following standards apply to all properties within the R-I-A, R-I, and N-C districts improved or intended to be improved with a single-family dwelling.

(a)Any new development or alteration which results in a change of building height is subject to the following:
(1)The height of the principal structure must be compatible with the height of the existing principal structures used as a single-family dwelling within 200 feet in either direction of the subject site, as measured from the side lot lines.
i.When only a portion of a principal structure on an adjacent lot falls within the 200-foot measurement, the entire structure will be included to determine compatibility.
(2)For the purposes of this section, compatibility shall mean that no building may be erected which exceeds 20% of the average height of the existing principal structures as determined in subsection (1) above, except as provided below.
i.For each foot the structure is setback within the lot beyond the minimum side yard requirement, an additional 2 feet of height may be added to the principal structure. The additional setback must be applied to all interior side lot lines.

As an example, if a structure in the R-I district is set back 12 feet from all interior side lot lines, an additional 4 feet of height may be added to the structure.

(12-10 = 2; 2x2 = 4).

ii.When the subject site is a corner lot, the additional setback is not required along the street side yard.
(3)No structure shall exceed the height limitations of the district in which it is located.
(4)The requirements of this Sec. 9-3-1 may be varied by the Director when it is determined that, for reasons of topography or other site specific conditions, the height limitations of this section are not required to achieve height compatibility between residential structures.
(b)In the R-I and N-C districts, new development on infill lots, as defined in Chapter 2-2, shall not deviate from the average build-to line within the established residential area by more than 15 feet.
(1)Where the established residential area may be difficult to determine, the Director shall have the authority to determine the average build-to line.

R-O District Use Standards

The following standards apply to all properties within the R-O (Residential and Office) district.

(a)Office.

No office establishment may exceed 3,000 square feet of floor area.

(b)Personal Service.

No personal service establishment may exceed 3,000 square feet of floor area.

§ 9-3-3

N-B District Use Standards

The following standards apply to all properties within the N-B (Neighborhood Business) district.

(a)All uses within the N-B district must be conducted indoors.
(b)No individual establishment may exceed 50,000 square feet of total gross floor area or provide more than 18,000 square feet of gross floor area on the ground floor.
