Article 18 — Applications and Procedures, Chapter 18-1 — DEFINITIONS

§ 18-1-1

Definitions

The following terms shall have the meaning in the Article as prescribed below:

Applicant. A property owner or their authorized representative who has petitioned the city for approval of an application under the terms of this article.

Application. A petition for approval of an application under the terms of this article.

Presiding official. The person chairing a meeting of the Planning and Appeals Board or the Governing Body in their official capacity.

Text amendment. An amendment to this ULDC.

Variance, Zoning. A minimal relaxation or modification of the strict terms of the height, area, placement, setback, yard, buffer, landscape strip, parking and loading, or other regulations which are dimensional in nature as applied to specific property when, because of particular physical surroundings, shape, or topographical condition of the property, compliance would result in a particular hardship upon the owner, and will not be contrary to the public interest.

Zoning decision. The final legislative action by a local government which results in:

(a)The adoption or repeal of a zoning ordinance;
(b)The adoption of an amendment to a zoning ordinance which changes the text of the zoning ordinance;
(c)The adoption or denial of an amendment to a zoning ordinance which rezones property from one zoning classification to another;
(d)The adoption or denial of an amendment to a zoning ordinance by a municipal local government which zones property to be annexed into the municipality; or
(e)The grant or denial of a permit relating to a special use of property;
(f)The grant or denial of a variance or conditions concurrent and in conjunction with a decision pursuant to subparagraphs (c) or (e) of this paragraph.
